ElliotMeds LLC operates an online telehealth platform that helps connect eligible users with independent licensed healthcare providers for medical chart review, clinical review, and, when medically appropriate, prescription treatment options.

ElliotMeds is not a manufacturer of medications.

ElliotMeds does not practice medicine.

ElliotMeds does not make medical decisions.

ElliotMeds does not guarantee that any user will receive a prescription, a specific medication, a specific dosage, a specific treatment plan, or a specific medical result.

All medical decisions are made solely by licensed healthcare providers using their independent medical judgment.

If a licensed healthcare provider determines that treatment is medically appropriate, the provider may issue a prescription. Approved prescriptions may be sent to a licensed pharmacy for fulfillment and shipment directly to the patient.

Acceptance of These Terms

By using ElliotMeds.com or any ElliotMeds service, you confirm that:

  • You understand these Terms.
  • You agree to be legally bound by these Terms.

If you are experiencing a medical emergency, severe allergic reaction, chest pain, trouble breathing, fainting, severe abdominal pain, severe vomiting, suicidal thoughts, or any other urgent medical condition, call 911 or seek emergency medical care immediately.

Provider-Patient Relationship

A provider-patient relationship is established only when a licensed healthcare provider accepts responsibility for reviewing your medical information and providing care.

Healthcare providers available through the ElliotMeds platform are independent clinical professionals.

Providers are solely responsible for:

  • Reviewing your medical information.
  • Determining whether telehealth is appropriate.
  • Determining whether treatment is medically appropriate.
  • Determining whether a prescription should be issued.
  • Determining the medication, dosage, directions, and duration of treatment.
  • Determining whether additional information, lab work, or follow-up care is needed.
  • Denying treatment when medically appropriate.
  • Modifying or discontinuing treatment when medically appropriate.
  • Referring you to in-person care when appropriate.

ElliotMeds does not control or interfere with provider medical judgment.

No Guarantee of Prescription or Treatment

Submitting an intake does not guarantee approval.

Completing a chart review does not guarantee approval.

Selecting a medication does not guarantee that the medication will be prescribed.

Selecting a dosage does not guarantee that the dosage will be prescribed.

A provider may:

  • Approve the requested treatment.
  • Deny the requested treatment.
  • Recommend a different treatment.
  • Recommend a different dosage.
  • Request more information.
  • Require lab work.
  • Require follow-up care.
  • Refer you to in-person care.
  • Determine that no treatment is appropriate.

Payment does not guarantee prescription approval.

No medication will be prescribed unless a licensed healthcare provider determines that it is medically appropriate.

Full Refund If Not Approved

If you are not approved for treatment by a licensed healthcare provider, you are eligible for a full refund of the amount paid for that treatment order.

This refund policy applies when treatment is denied by the reviewing provider before the order is sent to pharmacy processing.

Refunds for non-approval will be returned to the original payment method whenever possible.

ElliotMeds may require reasonable processing time to review and process refund requests.

A denial of treatment is not a guarantee that you are unhealthy or ineligible for future treatment. It means only that the reviewing provider determined, based on the information available at that time, that the requested treatment was not medically appropriate.

No Refunds After Pharmacy Processing Begins

Once an approved prescription or treatment order has been submitted to pharmacy processing, refunds are not available.

Pharmacy processing may include, but is not limited to:

  • Prescription transmission to the pharmacy.
  • Pharmacy review.
  • Medication preparation.
  • Compounding.
  • Labeling.
  • Packaging.
  • Dispensing.
  • Shipment preparation.
  • Carrier pickup.
  • Shipment to the patient.

Because prescription medications and compounded medications are prepared for a specific patient and may not be reused or resold, refunds are not available after pharmacy processing begins.

This policy applies even if:

  • You change your mind.
  • You no longer want the medication.
  • You selected the wrong product.
  • You selected the wrong dosage.
  • You entered incorrect information.
  • You fail to respond to communications.
  • You are unavailable for delivery.
  • You provide an incorrect shipping address.
  • A shipping carrier experiences a delay.
  • You fail to follow instructions.
  • You experience results that differ from your expectations.

ElliotMeds may, in its sole discretion, review exceptional circumstances, but it is not obligated to issue refunds after pharmacy processing begins.

Prescription Medication Return Policy

Prescription medications generally cannot be returned once dispensed, shipped, prepared, or handled by the pharmacy or patient.

For health, safety, regulatory, and pharmacy compliance reasons, ElliotMeds does not accept returns of prescription medication.

Medications may not be returned for resale, reuse, credit, or exchange.

You agree not to use medication prescribed to another person.

You agree to seek emergency care for urgent or severe symptoms.

You understand that failure to provide accurate medical information may result in serious harm and may lead to denial, suspension, or termination of services.

Compounded Medication Disclosure

Some treatments available through ElliotMeds may involve compounded medications.

Compounded medications are prepared by licensed pharmacies pursuant to valid prescriptions for specific patients.

Compounded medications are not FDA-approved.

The FDA does not evaluate compounded medications for safety, effectiveness, or quality before they are dispensed.

Compounded medications may differ from FDA-approved commercially available medications.

Availability of compounded medications may change at any time based on:

  • Federal law.
  • State law.
  • Pharmacy policy.
  • Provider discretion.
  • Ingredient availability.

ElliotMeds is not responsible for delays, losses, theft, damage, spoilage, or failed delivery caused by incorrect address, carrier error, weather, unattended packages, or user failure to retrieve the package.

Payment Terms

If you are not approved for treatment by a licensed provider, you are eligible for a full refund as described in these Terms.

Subscriptions and Recurring Billing

ElliotMeds may offer subscription plans, refill programs, recurring treatment programs, or recurring billing options.

By enrolling in a subscription, you authorize ElliotMeds and its payment processor to charge your payment method on a recurring basis at the disclosed price and billing interval.

Subscription charges may continue until canceled.

You are responsible for canceling before the renewal date if you do not want to be charged for the next billing cycle.

Cancellation stops future billing but does not guarantee cancellation of any order already submitted to pharmacy processing.

Once a subscription order, refill, or treatment shipment has entered pharmacy processing, refunds are not available.

A subscription does not guarantee continued prescription approval.

Each refill or continuing treatment may require provider review.

A provider may pause, deny, adjust, or discontinue treatment at any time based on medical judgment.

ElliotMeds may change subscription pricing, treatment availability, refill timing, pharmacy partners, or subscription features with notice where required by law.

If your payment method fails, ElliotMeds may retry the charge, pause your subscription, cancel your subscription, or request updated payment information.

Cancellation Policy

You may request cancellation of an order or subscription by contacting support@elliotmeds.com.

Cancellation requests are not guaranteed if the order has already entered pharmacy processing.

Orders are not refundable after pharmacy processing begins.

Subscription cancellation applies only to future billing cycles and future orders that have not entered pharmacy processing.

ElliotMeds may cancel orders for any reason, including:

  • Provider denial.
  • Pharmacy inability to fill.
  • Payment failure.
  • Fraud risk.
  • Eligibility issue.
  • Regulatory restriction.
  • Safety concern.
  • Incorrect information.
  • Abuse of platform policies.

If ElliotMeds cancels an order before pharmacy processing and no treatment is provided, the user may be eligible for a refund.

Chargebacks and Billing Disputes

If you believe there is a billing error, unauthorized charge, duplicate charge, or other payment issue, you agree to contact ElliotMeds first at support@elliotmeds.com before filing a chargeback or payment dispute.

ElliotMeds will review billing concerns in good faith.

You agree not to file improper chargebacks for valid charges.

You agree not to dispute a valid charge because:

  • You changed your mind after pharmacy processing began.
  • You did not receive the results you expected.
  • Your provider modified your requested dosage.
  • You failed to provide accurate information.
  • You failed to respond to provider or support communications.
  • You entered an incorrect shipping address.
  • You failed to retrieve your package.
  • A carrier delayed delivery.
  • You did not understand that prescriptions are not guaranteed.
  • You did not understand that refunds are unavailable after pharmacy processing begins.

ElliotMeds reserves the right to suspend or terminate accounts associated with chargeback abuse, payment fraud, or repeated billing disputes.

No Insurance Billing

ElliotMeds services are generally cash-pay.

ElliotMeds does not guarantee insurance coverage, insurance reimbursement, HSA reimbursement, FSA reimbursement, or third-party reimbursement.

You are responsible for all charges.

Receipts may be provided upon request, but reimbursement is not guaranteed.

You should contact your insurance plan, HSA administrator, or FSA administrator before using insurance-related funds.

Lab Work and Follow-Up Care

A provider may require lab work before prescribing or continuing treatment.

A provider may require follow-up chart reviews.

A provider may request updated health information.

You are responsible for completing requested lab work and follow-up care.

Failure to complete required labs, follow-ups, or medical updates may result in treatment delay, denial, pause, or discontinuation.

ElliotMeds is not responsible for delays caused by your failure to complete required steps.

Account Registration and Security

You may be required to create an account to use certain ElliotMeds services.

You agree to provide accurate account information.

You are responsible for maintaining the confidentiality of your login credentials.

You are responsible for all activity that occurs under your account.

You agree not to share your account with others.

You agree to notify ElliotMeds promptly if you suspect unauthorized access.

You should seek emergency medical care immediately for severe or urgent symptoms, including but not limited to:

  • Severe allergic reaction.
  • Swelling of the face, lips, tongue, or throat.
  • Severe abdominal pain.
  • Severe vomiting.
  • Fainting.
  • Severe dizziness.
  • Signs of infection.
  • Thoughts of self-harm.
  • Any other emergency symptoms.

  • You abused staff, providers, or pharmacy partners.
  • Continued service would create legal, regulatory, medical, safety, or payment processing risk.

Termination does not relieve you of payment obligations for valid charges.

ElliotMeds may retain records as required or permitted by law.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Except as otherwise required by applicable law or the arbitration provisions below, any dispute related to these Terms or ElliotMeds services shall be handled under California law.

Informal Dispute Resolution

Before filing a claim, arbitration, lawsuit, chargeback, or formal dispute, you agree to first contact ElliotMeds at legal@elliotmeds.com or support@elliotmeds.com and attempt to resolve the issue informally.

Your notice should include:

  • Your full name.
  • Your account email.
  • Your order number, if applicable.
  • A description of the issue.
  • The resolution you are requesting.
  • Any supporting documents.

ElliotMeds will review the dispute in good faith.

The parties agree to attempt informal resolution for at least 30 days before initiating arbitration, unless immediate legal action is required by law.

Arbitration Agreement

You and ElliotMeds agree that any dispute, claim, or controversy arising out of or relating to these Terms, the website, your account, payment, subscriptions, services, telehealth coordination, pharmacy coordination, or any relationship with ElliotMeds shall be resolved by binding arbitration, rather than in court, except as stated below.

This arbitration agreement applies to claims based on contract, tort, statute, fraud, misrepresentation, consumer protection, negligence, equity, or any other legal theory.

The arbitration shall be administered by a neutral arbitration provider, such as the American Arbitration Association or JAMS, under applicable consumer arbitration rules.

The arbitration shall take place in California unless the parties agree to remote arbitration, written submissions, or another location.

The arbitrator shall have authority to award the same individual relief that a court could award, subject to the limitations in these Terms.

The arbitrator’s decision shall be final and binding.

Judgment on the arbitration award may be entered in any court with proper jurisdiction.

Exceptions to Arbitration

Either party may bring an individual claim in small claims court if the claim qualifies.

ElliotMeds may seek injunctive or equitable relief in court to protect:

  • Intellectual property.
  • Confidential information.
  • Website security.
  • Platform integrity.
  • Fraud prevention.
  • Unauthorized access.
  • Misuse of services.

Nothing in these Terms prevents either party from reporting concerns to government agencies or cooperating with lawful investigations.

Class Action Waiver

You and ElliotMeds agree that disputes must be brought only on an individual basis.

You may not bring claims as a plaintiff or class member in any class action, collective action, consolidated action, private attorney general action, or representative action.

The arbitrator may not combine claims from multiple users into one proceeding.

The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual party’s claim.

If this class action waiver is found unenforceable as to a particular claim, that claim may proceed in court, but the rest of the arbitration agreement shall continue to apply to all other claims to the fullest extent permitted by law.

Jury Trial Waiver

To the fullest extent permitted by law, you and ElliotMeds knowingly and voluntarily waive any right to a jury trial for any dispute not subject to arbitration.

Force Majeure

ElliotMeds shall not be liable for delays or failures caused by events outside its reasonable control.

These events may include:

  • Natural disasters.
  • Weather events.
  • Public health emergencies.
  • War.
  • Terrorism.
  • Civil unrest.
  • Labor disputes.
  • Carrier delays.
  • Pharmacy disruptions.
  • Supplier shortages.
  • Power outages.
  • Internet outages.
  • Technology failures.
  • Payment processor outages.
  • Government action.
  • Regulatory changes.
  • Any other event outside ElliotMeds’ reasonable control.

Severability

If any part of these Terms is found invalid, unlawful, or unenforceable, the remaining parts shall remain in full force and effect.

The invalid or unenforceable provision shall be interpreted or modified to the minimum extent necessary to make it enforceable, if permitted by law.

No Waiver

ElliotMeds’ failure to enforce any provision of these Terms does not waive ElliotMeds’ right to enforce that provision later.

Any waiver must be in writing and signed by ElliotMeds.

Assignment

You may not assign or transfer your rights or obligations under these Terms without ElliotMeds’ prior written consent.

ElliotMeds may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, restructuring, change of control, or transfer of business operations.

Entire Agreement

These Terms, together with any applicable Privacy Policy, Telehealth Consent, refund policy, subscription terms, checkout disclosures, and other policies posted by ElliotMeds, constitute the entire agreement between you and ElliotMeds regarding your use of the website and services.
